Terms and Conditions of Greenseas® Greenseasons® Promotion

How to Claim the Gift

  1. Individuals must:
    1. purchase the required number of participating products listed in paragraph 12 (“Participating Products”) during the promotional period (see paragraph 5);
    2. go online to www.greenseas.com.au/greenseasons; and
    3. click on menu item Redeem, complete all personal details and the unique time codes from the required number of Participating Products. A unique time code is found on the top or bottom of the can/plastic tub of any of the Participating Products.
  2. Entry is via the internet. There is no additional cost to the claimant to submit their gift redemption entry other than the costs paid by the claimant to access the promotional website via their internet service provider. Any cost associated with accessing the promotional website is the claimant’s responsibility and is dependent on the internet service provider used.
  3. The gift is limited to the first 4000 claimants to submit a valid gift redemption entry in accordance with these Terms and Conditions.

Terms and Conditions

  4. Instructions on how to claim the gift form part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions. This Promotion is not valid in conjunction with any other offer or promotion involving Greenseas® products.
  5. The promotional period commences on 1 September 2008 and concludes on 30 January 2009 at 5.00pm (AEST) (“Promotional Period”). All gift redemption entries must be received by the Promoter by 5.00pm (AEST) on 30 January 2009. All entries are deemed to be received at the time of receipt of the entry in the Promoter’s promotional database and NOT at the time of transmission by the claimant.
  6. This Promotion is open to all Australian residents. Employees and directors of the Promoter , the Promoter’s related companies or any agencies involved in this Promotion, and the immediate families of each of those persons are ineligible to participate in this Promotion.
  7. Multiple gift redemptions are permitted provided that each gift redemption entry is submitted separately and in accordance with these Terms and Conditions. Maximum of one (1) entry per household per day.
  8. The Promoter reserves the right, at any time, to verify the validity of the gift redemption (including the unique time codes) and the claimant’s details (including the claimant's identity and place of residence) and to disqualify any claimant who submits a gift redemption that is not in accordance with these Terms and Conditions or who tampers with the gift redemption process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  9. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.
  10. Any incomplete, indecipherable, or illegible submission of a gift redemption will be deemed invalid. The Promoter is not responsible for any problems or technical malfunction of any equipment, software, failure of any entry to be received by the Promoter on account of technical problems or traffic congestion on the internet or any website, including any injury or damage to a claimant’s or other person’s computer relating to or resulting from participation in or downloading of materials in relation to this Promotion.
  11. The Promoter's decision is final on all matters in this Promotion and no correspondence will be entered into.
  12. Claimants are required to purchase any three (3) of the following Participating Products to redeem the gift (multiple purchases of the same product is acceptable):

  13. The first 4000 claimants to submit a valid gift redemption in accordance with these Terms and Conditions will each receive a Pasta Server, valued at $9.95 each (including GST where applicable). The value of the gift is a guide only and was correct at the time of printing. The Promoter accepts no responsibility for any discrepancy in gift value.
  14. The gift will be sent to verified claimants within 42 days after the date of receipt by the Promoter of the claimant’s documents to verify barcodes and/or claimant’s personal details. The Promoter will not be responsible for any delays in delivery, or failure of safe delivery of the gift.
  15. If the gift is unavailable, the Promoter, in its discretion, reserves the right to substitute the gift with another gift of equal value.
  16. The gift is not transferable nor exchangeable and cannot be redeemed as cash.
  17. The use of any automated entry software or any other mechanical or electronic means that allows a claimant to automatically enter repeatedly is prohibited and will render all entries submitted by that claimant invalid.
  18. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law, to disqualify any claimant; or to modify, suspend, terminate or cancel this Promotion, as appropriate.
  19. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees, agents and contractors) excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of this Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in gift value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; or (f) use of the gift.
  20. All entries become the property of the Promoter. The Promoter collects personal information in order to conduct this Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, gift suppliers and as required, to Australian regulatory authorities. Each gift redemption is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise requested by the claimant, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the claimant. No payment or other compensation will be made to the claimant for such use of their information. Claimants should direct any request to access, update or correct information to the Promoter. A copy of the Promoter’s privacy policy is relation to the treatment of any personal information collected may be accessed at www.heinz.com.au.

Note that gift stocks are limited, and only the first 4000 valid gift redemption entries will receive the gift. Redemptions for the Greenseas Pasta Server close at 5.00pm (AEST) on Friday 30th January 2009 or until stocks run out (whichever is earlier).
